Welcome to the online UNITED UTILITIES research community
UNITED UTILITIES WATER LIMITED (“UNITED UTILITIES”) has commissioned Explain Market Research Limited (“Explain Research”) to host and manage the UNITED UTILITIES’ research community on its behalf.
UNITED UTILITIES is registered in England and Wales under company number 02366678 and has its Registered Office at Haweswater House, Lingley Mere Business Park, Lingley, Green Avenue, Great Sankey, Warrington, WA5 3LP. Explain Market Research Limited is registered in England and Wales under company number 02880683 and has its Registered Office at The Core, Bath Lane, Newcastle Helix, Newcastle Upon Tyne, NE4 5TF.
By using the online UNITED UTILITIES research community, which is being managed by Explain Research, you are agreeing to comply with the terms and conditions of use set out below, which together with our Privacy Notice (located at https://intheflow.explainonline.co.uk/privacy-policy/) and the UNITED UTILITIES community guidelines (located at https://intheflow.explainonline.co.uk/Community%20guidelines/) form UNITED UTILITIES’ relationship with you in relation to this community.
If you are not happy with any part of these terms and conditions, please do not use the UNITED UTILITIES research community. You can unsubscribe from the UNITED UTILITIES research community or delete your user account at any time by clicking here and selecting ‘leave the community’.
Definitions
“Affiliate” means in respect of UNITED UTILITIES, a company which is a Subsidiary or which is a Holding Company of UNITED UTILITIES, or a Subsidiary of such Holding Company, in each case for the time being.
“Content” means everything contained in, or accessible from, the online community which has been produced by or on behalf of UNITED UTILITIES. “Content” does not include Postings made by Members.
“Holding Company” shall have the meaning given in section 1159 of the Companies Act 2006 and shall include parent undertakings as defined in section 1162 of the Companies Act 2006.
“Member” and “Members” refers to any person who uses the UNITED UTILITIES research community.
“Personal Data” has the have the meanings given under the UK GDPR.
“Postings” means all information, data, artwork, text, photographs, videos, messages and any other material which you or any other any Member posts on or uploads to the UNITED UTILITIES research community.
“Subsidiary” has the meaning given in section 1159 of the Companies Act 2006 and shall include subsidiary undertakings as defined in section 1162 of the Companies Act 2006
“UK GDPR” means the retained EU law version of the General Data Protection Regulation ((EU) 2016/679) (as amended from time to time).
“UU Group” means United Utilities Group plc (Company Number 6559020) and each of its Affiliates for the time being, and UU Group Member means any one of such companies.
“We”, “us” and “our” refers to UNITED UTILITIES and Explain Research.
“Website” means the website which hosts the community. These terms and conditions only apply to the website which hosts the community.
“You”, “your” and “yours” refers to you, the person using the UNITED UTILITIES research community
Changes to Terms
From time to time we may make changes to these terms; this will be done without any specific notice.
If the terms and conditions do change, the next time you login you will be presented with the revision and asked to agree to the revised terms before proceeding to use the UNITED UTILITIES research community.
We may suspend or withdraw our site
Our site is made available free of charge.
We do not guarantee that the Website, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all of any part of the Website for business and operational reasons.

This community contains Content which is owned by or licensed to us. This Content includes, but is not limited to, the Website design, layout, look, appearance and graphics.
Reproduction of the Content is prohibited.
All trademarks reproduced in this community, which are not the property of, or licensed to us, are acknowledged on the Website.
If you would like to share a text link to the UNITED UTILITIES research community, you do not need any permission for this. However, we reserve the right to require you to remove any such link if we do not feel that it is appropriate.
Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, or completeness of the Content or any other such information referred to on the UNITED UTILITIES research community, nor its suitability for any particular purpose.
You acknowledge that the Content or any other such information referred to on the UNITED UTILITIES research community, may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
Your use of any Content, information or materials on this community is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through the Website meet your specific requirements.
The experiences, ideas and opinions posted on the UNITED UTILITIES research community are those of individual Members. We cannot guarantee the accuracy of information contained within Postings. We cannot, in any circumstances, accept responsibility for errors or omissions in any of the Content of the Website, or for any action or decisions based on the Content. Neither are we be responsible for the consequences of reliance on any Content or Postings no matter how presented. Specific Postings made by UNITED UTILITIES research community Members with regards to their own account or service will be removed from the UNITED UTILITIES research community and, with the Member’s permission, provided to UNITED UTILITIES who will respond if and as they are able. UNITED UTILITIES may respond to any queries or correspondence from Members but provides no warranty or guarantee as to either (i) the provision of a response; nor (ii) the accuracy of any such response.
Personal Data
We treat your Personal Data with great care, and have an extensive data protection compliance programme. Our Privacy Notice explains in more detail how we handle your Personal Data.
In order to keep your Personal Data safe, please do not include any Personal Data, whether about yourself or someone else, in your Postings. You need to be aware that, if you include any Personal Data in your Postings, it may not be secure and may be accessible by other Members. If you include Personal Data about other people you may also be liable yourself.
When selecting your Member username and profile picture, be mindful that these can be seen by all other Members in the UNITED UTILITIES research community. Please do not select a username or picture that is personally identifiable.
Postings
You are welcome to upload your Postings as you wish, subject to these terms and conditions, and to the UNITED UTILITIES community guidelines. You warrant that any such Posting complies with those guidelines, and you will be liable to us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.
You affirm, represent and warrant that you own or have the necessary licences, rights (including copyright and other proprietary rights), consents and permissions to publish and otherwise use any content of your Postings. You are responsible for all your Postings. If you did not create your Postings yourself, you are responsible for obtaining the owner’s consent to use it on the Website or in connection with the UNITED UTILITIES research community.
Your Postings will be visible by all Members of the UNITED UTILITIES community.
In order to share in full, and make the UNITED UTILITIES research community a success, by using the Website, you agree to grant us a non-exclusive, perpetual, worldwide, irrevocable, transferable and royalty-free licence (with the right to grant sub-licences) to us to:
- host, use, reproduce, modify, run, adapt, translate, distribute, publish and share your Postings with other Members of the UNITED UTILITIES research community on the Website; and
- use your Postings for:
- content analysis and market research purposes;
- documenting any findings from any discussions, surveys and polls that take place on the UNITED UTILITIES research community; and
- any publicly available UNITED UTILITIES communications, media publications and marketing outside of the Website (provided such publication will be undertaken on an anonymized basis).
This means that this licence will not be exclusive to us (in that you can allow other people to use your Postings too) (for example, including but not limited to other Members, or to any sub-contractors of UNITED UTILITIES).
Notwithstanding the above, in respect of any Personal Data contained within your Postings, such Personal Data shall only be used by us as outlined in our Privacy Notice.
In respect of the licence above, you acknowledge and accept that your Postings will be made available to other Members and that we accept no liability for the use of any of your Postings by any other Members.
You agree to waive all moral rights in any content of your Postings that you now (or may at any future time) be entitled to under the Copyright, Designs and Patents Act 1988 as amended from time to time.
While we host the UNITED UTILITIES research community we are not responsible for the content of the Postings, which are provided by other Members. We therefore have no liability for any losses or damage which are in any way related to the content of any Postings.
If anyone notifies us that anything in your Postings has infringed their intellectual property rights, we may withdraw any, or all, of your Postings immediately, in order for such claims to be investigated.
If anything in your Postings is found to have infringed another party’s intellectual property rights, and we suffer any losses or damages as a result, we reserve the right to claim against you in order to recover our losses as a result of all claims and proceedings arising from such infringement.
Moderation and Member conduct
You are responsible for how you behave towards other users of the Website. Explain Research will act as site moderator, and will monitor any disputes between Members, but shall not be responsible for resolving them.
Unauthorised use of this Website may give rise to a claim for damages and/or be a criminal offence.
Cookies
The Website uses cookies to track user sessions. Alongside Google Analytics, we only use two cookies. The first cookie is ‘session’, which is deleted when your browser is closed.

We reserve the right to suspend or withdraw the Website and/or the UNITED UTILITIES research community at any time without notice. Equally we reserve the right to suspend or terminate your individual registration at any time. While we would try to explain our reasons for doing so, it may not always be possible to provide such an explanation at the same time as the suspension or termination.
In addition to these terms and conditions there are also UNITED UTILITIES community guidelines which we ask all members of the UNITED UTILITIES research community to adhere to.
Viruses
We do not guarantee that the Website will be secure from bugs or viruses.
You are responsible for configuring your information technology, computer programmes and platform to access the Website. You should use your own virus protection software.
You must not misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Website, the server on which the Website is stored or any server, computer or database connected to the Website. You must not attack the Website via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Website will cease immediately.
Communications and email alerts
By creating an account on the UNITED UTILITIES research community, you are giving consent to receiving communication emails from the community. The receipt of these emails is important to help you keep up to date on the community and its content. These emails will contain information relevant to the UNITED UTILITIES research community, such as updates and reminders on new community Postings and member interactions and prize draw announcements.
Community moderators may also email you in relation to any user account queries or issues, such as any breach of the UNITED UTILITIES community guidelines.
If you do not wish to receive emails alerts from the community please do not use the UNITED UTILITIES research community.
Third party links
On occasion we may include links to third party websites on this Website. Where we provide a link it does not mean that we endorse or approve that website’s policy towards visitor privacy. You should review their privacy notice before sending them any Personal Data.
Where UNITED UTILITIES wish you to take part in any research which is not moderated by Explain Research, and a link to such research appears in the UNITED UTILITIES research community, this will be made clear.
Liability
For the avoidance of doubt, we (and any UU Group Member and any employees, servants, agents or sub-contractors of us or of any UU Group Member) shall not be in any way liable to you in respect of your use of the UNITED UTILITIES research community, whether arising in contract, tort (including negligence) breach of statutory duty, restitution, under any indemnity or otherwise, to the fullest extent permitted by law.
Prize draws
Contribution in the UNITED UTILITIES research community may enter Members into a prize draw. Where this is the case, we shall signpost you to the relevant terms and conditions that will apply to any such prize draw. Further information is available on the 'Incentives’ page.

Miscellaneous
You acknowledge that these terms and conditions and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with English law and your agree to submit to the exclusive jurisdiction of the English courts.
